On a legal standpoint it is, at least according to article 32 & article 147 of the Geneva Convention.In 2005,the CIA destroyed 92 tapes after a report determined depiction of "Cruel,inhuman and degrading treatments as defined by the International Convention against torture". Not prosecuting the perpetrators and the instigators is not an option.
